Frequently Asked Questions

If you’re considering divorce in Ontario, it’s normal to have questions about cost, timelines, and how the process works.

The answers here explain the uncontested divorce process in plain language and outline how we can help as licensed Family Law Service Providers.

If you don’t see your question here, we’re happy to discuss your situation during a free consultation.

  • 1. Do I need a lawyer to get divorced in Ontario?

No. Many uncontested and joint divorces can be completed without hiring a lawyer.

As Law Society of Ontario licensed paralegals, who are authorized Family Law Service Providers, we help with the paperwork, filing, and court process so you can complete the divorce correctly at a clear flat fee.

  • 2. What is an uncontested or joint divorce in Ontario?

An uncontested divorce means both spouses agree that the marriage has broken down and there are no disputes about parenting, support, or property.

A joint divorce is when both spouses apply together using the same application.

These types of divorces focus on completing the required Ontario court forms and filing process correctly, rather than arguing issues in court.

  • 3. How long does a divorce take in Ontario?

Once your completed divorce application is filed, most Ontario courts require several months to process the paperwork before a judge can grant the final divorce order.

Timelines depend on court workload and whether documents are prepared correctly the first time.

Accurate forms and proper filing help avoid delays or returned applications.

  • 4. What court fees are involved?

Ontario requires government filing fees for every divorce application.

These fees are separate from our flat service fee and are paid directly to the court.

Additional disbursements may apply for items such as printing, commissioning, or obtaining a marriage certificate if you do not already have one.

We explain all required fees before you proceed so there are no surprises.

  • 5. Do we need to be separated for a full year?

In most cases, yes. The Divorce Act requires spouses to live separate and apart for at least one year before a divorce can be granted.

You can begin preparing and filing your application before the year is complete, but the court will not issue the final divorce order until the one-year separation requirement has been met.

  • 6. What is the difference between a simple and a joint divorce?

A simple divorce is filed by one spouse, while a joint divorce is filed together by both spouses.

Both options are available when the divorce is uncontested and all other family issues have already been resolved.

We can help you understand which option fits your situation and prepare the correct Ontario forms.

  • 7. Can you help if I have already started my case?

Yes. If you have begun the process on your own and are unsure what to do next, we can review where you are in the Ontario procedure and assist with the remaining forms and filing steps within FLSP scope.

Many clients come to us after receiving a court notice requesting corrections or additional documents.

  • 8. Do you provide legal advice or represent contested matters?

No. As licensed Family Law Service Providers, we assist with procedural steps such as preparing and organizing Ontario divorce forms, reviewing documents for accuracy, explaining court processes, and filing.

We do not provide legal advice, negotiate disputes, or represent clients in contested litigation.

If your matter requires legal advice, we can help you understand how to seek that support.

  • 9. What do I need to get started?

To begin, we typically need a copy of your marriage certificate, basic information about both spouses, current addresses, and confirmation that all parenting, support, and property issues are already resolved.

During your free consultation we will provide a simple checklist tailored to your situation.

  • Is the consultation really free?

Yes. Your initial consultation is completely free and without obligation.

We use this time to confirm that your matter qualifies for an uncontested or joint divorce, explain the process, outline court fees, and answer your questions so you can decide whether our service is right for you.
